GENERAL TERMS AND CONDITIONS FOR THE USE OF PHOTOS, VIDEOS OR OTHER MATERIALS OF coatmaster AG

Any reproduction or use of documents from the coatmaster marketing material site to which coatmaster AG has exclusive proprietary rights is prohibited without the prior consent of coatmaster AG and may only be for an application approved by coatmaster AG or an official distributor. The use of the coatmaster marketing material page in no way implies an assignment of rights, which remain the exclusive property of coatmaster AG. Any misuse of the coatmaster marketing site, in whole or in part, may result in legal action.

Copyrights

All images, videos and other materials from the coatmaster marketing materials page are the exclusive property of coatmaster AG or third parties who own the copyright and have authorised coatmaster AG to publish them. These materials are royalty-free for the exclusive purpose of marketing coatmaster AG and its affiliates.

Photo credits

The image credit, photographer’s name and/or image ID contained in the file of the image, video or other material must be included in any reproduction/publication. In the event of failure to do so, coatmaster AG is entitled to demand compensation for the lack of identification. If the material does not bear an image credit from coatmaster AG, the file used must bear the following reference: © coatmaster AG.

Use of images

The images, videos and other materials available on the coatmaster marketing materials page are intended for publication by coatmaster AG and authorised distributors. Any other use of these materials in any manner requires the prior written consent of coatmaster AG.

IN ANY EVENT, ALL MATERIALS PUBLISHED ON “coatmaster.com” AND “coatmaster.ch” ARE EXCLUSIVELY FOR THE PURPOSE OF ADVERTISING THE PRODUCTS OF coatmaster AG. UNDER NO CIRCUMSTANCES MAY THESE MATERIALS BE ASSOCIATED WITH ANY OTHER PRODUCT, BRAND OR COMPANY.

If the image is manipulated or altered, the user is creating a derivative work. Under current copyright legislation, the author of the original work is considered the copyright owner. Thus, the user does not hold copyright over the derivative work, as he is not the owner of the original work.

Proof of publication

Proof of publication of the materials used must be sent to coatmaster marketing department on their request (e.g. a copy of the issue, the website URL, a PDF mock-up, a screenshot, etc.).

Applicable law, place of jurisdiction and contractual documents

These Terms of Use are governed by Swiss law. Any use that is not in accordance with these Terms of Use for the use of the coatmaster marketing materials site may be actionable in a court of competent jurisdiction. As these terms of use and restrictions may be changed at any time without prior notice, the user undertakes to read and take note of them each time he/she uses them.
